TRAIN Act Could Derail AI Innovation 

Bill would grant copyright holders access to AI training records

Today, Senate lawmakers introduced the TRAIN Act, which would allow copyright holders to access training records for AI models to determine if their work was used. If enacted, the legislation could inflict new legal uncertainty on AI developers and hinder competition in the Generative AI (GenAI) space. 

“The TRAIN Act isn’t ready for the rails, and certainly shouldn’t leave the station until we get more clarity from the courts. We don’t need new regulations for what may prove perfectly legal conduct,” said Adam Eisgrau, Senior Director of AI, Creativity, and Copyright Policy at Chamber of Progress. “Dozens of courts are weighing whether training AI models on content from the internet – including copyrighted works – is protected under the fair use doctrine. If it is, no advance permission is needed under this flexible doctrine that’s fueled tech innovation for almost 50 years.”
