Undermining Fair Use Would Hinder Creativity and Competition

Creative professionals condemn copyright protections for generative AI

Today, more than 10,500 creative professionals signed a short, 29-word statement rebuking the “unlicensed use of creative works” to train artificial intelligence models. The letter’s call to action implies a dismantling of established U.S. copyright law, including the fair use doctrine, which allows for the use of copyrighted material without permission in many everyday circumstances. 

“A licensing regime for generative AI would seriously compromise creativity, competition, and existing bedrock copyright law,” said Adam Eisgrau, Senior Director of AI, Creativity, and Copyright Policy at Chamber of Progress. “There’s no shortage of ongoing court cases examining fair use in generative AI. As we wait for more clarity from the courts, the last thing that creatives and innovators need is a premature intervention that would thwart creativity and undercut competition.”
